Terms and Conditions

PROGRAMME DETAILS

The COACH agrees to provide the following support to the CLIENT:

  • One introductory 60 minute Zoom call, thereafter followed by either bi-weekly 30-minute Zoom calls (Gold Package) or weekly 30-minute Zoom calls (Platinum Package)

  • Weekly WhatsApp check ins

  • One email check in (Gold Package) or two email check ins (Platinum Package) email. Please note that the COACH may require up to 72 hours in order to respond to emails.

  • Evolving nutrition and lifestyle programme

  • Exercise, testing and supplement recommendations (the latter two may be at an extra charge).

  • Either one or two personal training sessions a month (if this option is selected at checkout)

The service provided to the CLIENT by the COACH is nutrition therapy and health/lifestyle coaching, as designed jointly with the CLIENT.

Coaching, which is not directive advice, counseling, or therapy, may address overall goals, specific projects, or general conditions in the CLIENT's life or profession.

Coaching services may include setting priorities, establishing goals, identifying resources, brainstorming, creating action plans, asking clarifying questions, and providing models, examples, and in-the-moment skills training.

FEES

The fee for each month of coaching is £140 (Gold) or £270 (Platinum) processed automatically each month through COACH’s online payment processor, Samcart. You are asked to commit to an initial period of three monthly payments before terminating the agreement. Additional charges will be made if PT options are selected.

REFUND POLICY

In accordance with UK law, you have a 14-day 'cooling off' period in which to cancel. Thereafter, monthly payments are nonrefundable. The COACH is not able to provide refunds for any and all collected payments. The CLIENT understands this provision, and agrees that he / she / they are not entitled to a refund once payment has been issued to the Coach outside of the 14 day cooling off period.

The Client further agrees and understands that changing their mind about the Programme, failing to follow through or understand the details of the Programme, not experiencing the results he/she expected or desired, or experiencing any other similar situations does not entitle them to a refund.

HOLIDAYS & BREAKS

Programmes are packaged pro-rata to allow for 48 weeks of coaching and/or PT sessions to cover holidays taken either by the COACH or the CLIENT. The COACH will attempt to 'make up' any sessions outside of these, providing the relevant notice period is given as outlined below.

TERMINATION

The CLIENT and COACH agree to provide one another with a minimum of 14 days notice if either party desires to cancel further service. Termination notice must be in writing via email and notice can be given after an initial three-month period.

CONFIDENTIALITY

The COACH and all representatives of Fabulous Beyond 40 affirm that all information provided by the CLIENT will be kept strictly confidential, as permissible by law.

Both the CLIENT and the COACH agree that everything shared during coaching sessions, through email, or any other correspondence is completely confidential and will not be shared with any outside parties.

PROCESS AND INTENT

Throughout the coaching relationship, the COACH will engage in direct and personal conversations with the CLIENT, which will include asking explicit questions, making requests and serving as a nutrition, health and lifestyle consultant offering explicit advice and direction.

The purpose of these interactions is to remind the CLIENT of their own intentions, and coach them to realise them. In order for our coaching relationship to achieve the maximum result, the COACH asks that the CLIENT agree to the following:

  • The CLIENT accepts that is their responsibility to book sessions as per their package and utilise email contact in a similar manner.

  • Please be on time to all appointments. If you will be late, notify the COACH in advance. If you will miss an appointment, notify the COACH at least 24 hours in advance. Appointments missed without 24 hours notice will only be rescheduled at the COACH’s discretion.

  • Be honest and participate fully. Recognise that our sessions are a safe place to look at what you really want, and what it will take to make it happen.

  • Make a commitment to the action plans you create, and do what you have agreed to do.

  • Understand that the power of the coaching relationship can only be granted by you, and commit to making the relationship powerful. If you see that coaching is not working as you desire, communicate and take action to return the power to the relationship.

The CLIENT's agreement indicates compliance with the above requests, and understanding of the services to be provided.

The CLIENT also acknowledges that the COACH cannot and does not offer any guarantees about results gained through the coaching process. The CLIENT’s success is strictly dependent on the CLIENT’s unique skills, circumstances, motivation, follow through, and perseverance.

The Nutritional Therapy Descriptor

Nutritional Therapy is the application of nutrition science in the promotion of health, peak performance and individual care. Nutritional therapy practitioners use a wide range of tools to assess and identify potential nutritional imbalances and understand how these may contribute to an individual's symptoms and health concerns. This approach allows them to work with individuals to address nutritional balance and help support the body towards maintaining health. Nutritional therapy is recognised as a complementary medicine and is relevant for individuals with chronic conditions, as well as those looking for support to enhance their health and wellbeing.

Practitioners consider each individual to be unique and recommend personalised nutrition and lifestyle programmes rather than a 'one size fits all' approach. Practitioners never recommend nutritional therapy as a replacement for medical advice and always refer any client with 'red flag' signs or symptoms to their medical professional. They will also frequently work alongside a medical professional and will communicate with other healthcare professionals involved in the client's care to explain any nutritional therapy programme that has been provided.

The Nutritional Therapist (NT) requests that the Client notes the following

  • The degree of benefit obtainable from Nutritional Therapy may vary between clients with similar health problems and following a similar Nutritional Therapy programme.

  • Nutritional advice will be tailored to support health conditions and/or health concerns identified and agreed between both parties.

  • Nutritional therapists are not permitted to diagnose, or claim to treat, medical conditions.

  • Nutritional advice is not a substitute for professional medical advice and/or treatment.

  • Your Nutritional Therapist may recommend food supplements and/or functional testing as part of your Nutritional Therapy programme and may receive a commission on these products or services.

  • Standards of professional practice in Nutritional Therapy are governed by the CNHC Code of Conduct.

  • This document only covers the practice of Nutritional Therapy within this consultation, and your practitioner will make it clear if he or she intends to step outside this boundary.

The Client understands and agrees to the following

  • I am responsible for contacting my GP about any health concerns.

  • If I am receiving treatment from my GP, or any other medical provider, I should tell him/her about any nutritional strategy provided by my nutritional therapist. This is necessary because of any possible reaction between medication and the nutritional programme.

  • It is important that I tell my nutritional therapist about any medical diagnosis, medication, herbal medicine, or food supplements, I am taking as this may affect the nutritional programme.

  • If I am unclear about the agreed nutritional therapy programme/food supplement doses/time period, I should contact my nutritional therapist promptly for clarification.

  • I must contact my nutritional therapist should I wish to continue any specified supplement programme for longer than the original agreed period, to avoid any potential adverse reactions.

  • Personal recording by the client of consultations using any form of electronic media is not allowed without the written permission of the Nutritional Therapist.

By using this website, you are deemed to have agreed to these Terms and Conditions of Use. We reserve the right to change, modify, add or remove portions of these Terms and Conditions of Use at any time, therefore it is advised that you periodically check this document for changes. Furthermore, the way we use, store and protect any personal data we collect from you, or that you provide to us, will also be detailed within this notice.

THE INFORMATION WE COLLECT

When you book an appointment, register with one of our challenges or book one of our course, we collect personal details such as your name, email and telephone. This information is used to identify you and contact you about the services you have booked.

To provide a safe and effective service we may also need to collect information such as your medical background and lifestyle choices. This information is only used to make sure we can advise you as effectively as possible.

While you use the website we also receive information about your computer such as your IP address, operating system and browser details. This information helps us provide a better website experience for you.

CONSENT

When you provide us with your personal information in a course, booking an appointment, completing your intake form, making a payment or contacting us about our services, you are giving your consent to us collecting that information and using it for that specific reason.

We will not use your personal information for any secondary reason, like marketing, unless we have asked you directly for consent to do so.

How do I withdraw my consent?

For the purpose of legal protection we are required to hold the personal information you have given to us in the course of the services we provide and any notes about you for a minimum of seven years.

Seven years after your last contact with us, we will permanently delete all your personal information that we hold.

If you withdraw your consent during the seven year retention period, we will archive your data until the seven year period expires. Whilst your information is archived, we will not access or process it in any way except if needed for legal protection or if I’m required to do so by law.

How can I access, update or amend my personal information?

You have the right to review the personal information we store about you at any time. These will be sent by email, in a Microsoft Word document attachment. If you undertake nutrition therapy, training or other treatment with us, you may receive access to a secure Google Drive that stores all your information and gives you immediate access.

You also have the right to request we update or amend your data if it is incorrect.

DISCLOSURE

Unless required to do so by law, we will not otherwise share, sell or distribute any of the information you provide to us without your consent.

DATA HANDLING & STORAGE

Our appointment booking and document service is provided by OnceHub. They specialise in providing secure collection, processing and storage personal data for healthcare practitioners worldwide.

Your data is stored through OnceHub using their data storage facilities, databases and the OnceHub web framework, on secure servers is always encrypted when in storage and whilst being transmitted across the internet.

PAYMENT

Payments are in cash, via bank transfer or payment processors such as Stripe, Paypal and Apple Pay. As such, no information is stored by us.

THIRD-PARTY SERVICES

In general, the third-party providers we use will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. If you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in the UK and your transaction is processed by a payment gateway located in the United States, then your personal information used to complete that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy.
